Supreme Court permits GGSIPU to hold MBA admissions for 2019-20 through CAT

Supreme court on June 6, 2019, granted permission to Guru Gobind Singh Indraprastha University (GGSIPU) to admit candidates to its MBA courses through national level entrance test, that is Common Aptitude test (CAT). The Supreme Court stayed two orders which were passed by the Delhi High Court according to which Guru Gobind Singh Indraprastha University (GGSIPU) was required to conduct its own entrance test for the admission to MBA Course.

One order was passed by a Single Judge Bench of Delhi High Court on April 12, 2019, while another order was passed by a Division Bench of the High Court on May 29, 2019. For admission to MBA Course for academic session 2019-20, in Guru Gobind Indraprastha University (GGSIPU) will be done through Common Admission Test (CAT).

As per the order of April 12, 2019, by the Delhi High Court, GGSIPU would be required to conduct a fresh Common Entrance Test (CET) for admission to the MBA Course for academic session 2019-20. A Division Bench of the High Court hearing the Letters Patent Appeal( LPA) passed an interim order on May 24, 2019, granting temporary relief to the Petitioner-GGSIPU.

It allowed the Petitioner University that is GGSIPU to hold MBA admissions for this academic year based on Common Admission Test (CAT) score. However, an application seeking review of that interim order was allowed and the High Court on May 29 ordered that the admissions shall be held in accordance with the directions as per the order of April 12, 2019.

Guru Gobind Singh University moved the Supreme Court challenging this order of May 29 by which the High Court directed that admission to the MBA course shall be held in accordance with the order passed on April 12 by a Single Judge Bench in the petition filed by ‘Self Financing Educational Institutions Association’. Senior Advocate Rakesh Khanna along with advocates Ranjeeta Rohatgi and Ekta Sikri appeared for the Petitioner-University.

The petitioner has also given the example of a recent order passed by the Supreme Court in which similar orders passed by the Delhi High Court with respect to LLB admissions stayed. In that case, the Supreme Court had allowed the Petitioner-University to conduct LLB admissions using the score of Common Law Admission Test (CLAT) instead of conducting a fresh CET.

The Supreme Court yesterday stayed the High Court orders of May 29 and April 12, 2019.

The admissions for MBA can now be conducted by the Petitioner-University on the basis of CAT score.
